Terms & Conditions

We are looking for very specific content and we need your help to find it. So when thinking about sending us in a clip, please consider the following principles:

  1. It needs to be yours. That means that you recorded it yourself while it was happening.
  2. It can't be insulting or inaccurate.  We don't want to make any enemies here so please think about the content you are providing and if you think it is going to offend anyone, please don't submit it.
  3. Someone will want to watch it. Our preference is for funny content but we also like content that is weird or just plain stooped.
  4. The higher the video quality, the better. People much prefer to watch clips they can see - so go for video cameras rather than phones, OK?

Our Terms & Conditions are set out below. They will apply to any video you submit. Have a quick run through them - we have tried to write them in plain English.

Your Acceptance
There are two main sets of Kamikaze terms and conditions (we'll call them "Ts & Cs"). The first are these terms and conditions and the second is our PRIVACY POLICY (www.kamikazevideos/privacy.php). Both sets of Ts&Cs apply to any activities involving interaction with this website so although we know it's boring, it is worth having a read through. We have tried to make it as simple as possible. If you are not 18 or not legally able to consent to these Ts&Cs, it's probably best of you don't proceed.

Kamikazevideos Website
These Ts&Cs apply to all interaction with this website, including if you:

  • Just view content
  • Actually submit content
  • Click through to other sites (although those other sites are probably not owned by Kamikaze and in any event will have their own applicable terms and conditions)
  • Participate in competitions (although there might be additional Ts&Cs in that situation); and
  • Anything else you can imagine.

Just to be clear, those websites owned by other parties .  we are not responsible for.  We don't know what content will be on them at any given time and in any case we cannot change it.  So we are not going to take any responsibility for whatever you find there (although we think it is likely to be pretty cool).  Remember there will be terms and conditions regarding use and/or privacy on each third party site so please check them out. 

Website Access
We want you to use the website as much as you like, but we do have some rules that must apply to protect the Kamikazevideos business. 

  • The first is that you use the website for personal use.  This means that you cannot use it to make money (commercial use) or generally display it to the public without specific permission from us.
  • The second is that you don't steal our content!  That includes the clips, the website itself and anything else you find on our site.  (BTW, this includes taking the content and then changing it.)
  • The third is that you don't change anything on the site unless you have to, to use it.

Just to be clear, the clips set out on this site are submitted by other people.  We try to ensure that all content is harmless (except maybe to the people in it!) but we do not take any responsibility for it and in no way endorse it.  If you feel uncomfortable or concerned about any clip, please let us know and we will immediately investigate it and make a decision on whether we should remove the clip.

The other side of that, however, is the fact that there will be content on this site from lots of people all over the world and which pushes the boundaries a bit.  That is the whole reason for the site.  So we all need to be mature about this and understand that there may be content which is or is bordering on being offensive, indecent or objectionable.  In order to manage the risk and provide you with the content that Kamikazevideos is famous for, we need you to waive the right to take any action against us in respect of the content to be found on the site.  If you do not agree to this, please do not use the site. 
Obviously all the other Ts&Cs apply too, but that is obvious really.

Copyright
This is where we get to explain the © symbol which applies to this whole site.  Basically, it means that all the content on the Kamikazevideos Website is ours and it protected.  It basically means that you can't copy or use it in any way without our permission.  As you will have seen above, we have given you permission subject to certain limitations.  However, it is important to note that these limitations are enforceable by laws throughout the world.

Two final points on copyright:
Where we have not granted permission to do something you need to assume that you cannot do it.

Please don't remove any of the © signs or Ts&Cs throughout the site when you are showing it to someone else.  (To be honest, we don't know why you would want to, but we have to say it anyway.)

Trademarks
Some of the words used in the website and specific marks used to identify Kamikazevideos brands and concepts.  One obvious example is Kamikazevideos.  This is just another reason not to use anything you find on this site for any purpose other than personal viewing, and especially not for a commercial purpose. 
Just to be clear, we only permissible use of our trademarks is when you access this site.

User Submissions
This is the part that relates to the clips that you submit. 
In order to post the clip on the site and otherwise use it for Kamikazevideos commercial activities, we have to apply a few principles to all clips submitted:
The first is that they will be regarded as non-confidential
Secondly, you agree to allow us to use the clip in any way we want, without charge.  (Unfortunately, we have to use the legal terminology here.  In legal terms, you grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, edit, translate, distribute, perform, display, and make derivative works of the clip, and your name, voice, and/or likeness as contained within it, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, including the unfettered right to sublicense such rights, in perpetuity throughout the universe.)
As we mentioned above, we are relying on the fact that you own or are otherwise allowed to provide us with the clip so that we can use it in the manner set out above.  Bear in mind that it may have images of you or your friends - you need to be happy that you (and others) might see yourself on this site!  While you might be happy about this, your friends might not so please make sure you have the consent (preferably in writing) of each person in each clip that you are going to submit the clip to us for use on the website and generally by Kamikazevideos.
Also, we do not want content that is going to upset people.  Therefore, we need you to agree that you will not send in clips which contain material:

  • someone might want to keep confidential,
  • which is untrue or inaccurate, especially if they could cause someone's reputation to suffer
  • that would offend people or break the law, especially material which is blasphemous or pornographic (there are other websites for that J) or which otherwise might cause Kamikaze videos to get into trouble.
  • impersonates another person (even if it is very funny).

Contests and Ratings
From time to time we will be conducting contests.  There are some important things you should know about the contests we hold:

  • All submissions need to be received by us by midnight on the final date of the submission period.  Please allow some time for uploading of your submission to ensure it gets to us by midnight.
  • Please only submit each video once!!
  • Winners are usually selected by users of the site by submitting a rating.  The highest rating wins!
  • We will do everything we can to ensure that the voting process is fair.  This may involve disqualifying votes where we have reason to believe that there has been unfair use of ratings.
  • For obvious reasons, all taxes associated with the prize must be borne by you.
  • In some countries, the contest might be subject to additional terms and conditions or restrictions.  Where this is the case, Kamikazevideos will be bound by those limitations.
  • Write to us if you want to know who actually won.

Of course all the other rules in these Ts&Cs apply about only submitting original material shot by you, etc.

Now for the really important legal stuff.  Sorry, but we have to include this.

YOU AGREE THAT YOUR USE OF THE KAMIKAZEVIDEOS WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, KAMIKAZEVIDEOS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. Indemnity
You agree to defend, indemnify and hold harmless Kamikazevideos, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from: (i) your use of and access to the Kamikazevideos Website; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive this Agreement and your use of the Kamikazevideos Website.

  • General
    This website is based in the UK and is bound by UK laws rather than the laws of the countries in which you access it.
  • Please contact us with any concerns, claims or issues in dispute and we will try to resolve it with you.  Failing this, any matters will need to be decided in the UK by courts in London, England.
  • There is also a Kamikazevideos Privacy Policy at http://www. Kamikazevideos.com/privacypolicy and this, the other Ts&Cs and any specific obligations published by Kamikazevideos on the website describe the legal relationship between you (as the use of this site) and Kamikazevideos concerning the Kamikazevideos Website.
  • If any part of the Ts&Cs is deemed invalid by a court, then it shall be removed from the agreement and only the remaining provisions will apply.
  • If we fail to enforce a particular right under this agreement, that doesn't mean that we can't still enforce that right in the future.
